Supreme Court to Hear Case Concerning ‘Illegals’ & ID Theft

Earlier this week the US Supreme Court agreed to hear an appeal case concerning an ‘illegal’ immigrant who allegedly used a social security number belonging to another person. This case concerning a charge of aggravated identity theft will be heard sometime in 2009. It is significant because federal prosecutors have used this identity theft charge against many of the 300 immigrants caught up in the raids at the meat packing plant in Postville.

This charge which is based from a new law adopted in 2004 originally was intended to combat identity theft but has now found new purpose in the federal government’s attempts to ‘combat illegal immigration’. The punishment for this crime is much greater than a simple violation of immigration code which has made it a popular ‘tool’ for prosecutors who appear anxious to throw the kitchen sink at these people in the hope that it sticks.

What’s troublesome to me is that the federal government has no qualms about accepting social security, medicare, and federal employment tax withholdings from these individuals paychecks. Presumably this person was paying the feds using this invalid number and name, the Internal Revenue Service ans Social Security Administration knew that the names and numbers didn’t match but apparently they don’t care as long as your PAYING THEM MONEY. My question is, wouldn’t the feds acceptance of this money from these people’s paychecks make them an accessories to a crime? I mean if this really is aggravated identity theft then couldn’t it be construed as the equivalent to receiving knowingly stolen property on the part of the IRS and SSA?

Anyways, to the best of my knowledge a number in and of itself doesn’t identify a person, someone would need the name and the number used in conjunction. And to the best of my knowledge this individual just used a random number without having the corresponding name. Not sure how much theft could be done with just a number. Also, what about those individuals that used numbers that were invalid such as those that started with the number nine? For example, 999-99-9999, if someone used that number could they be charged with identity theft since there’s no individual with that number. Are prosecutors checking each of these social security numbers to see if there is a real person currently using that number?

In summation, the case appears to have merit and hopefully the Supreme Court will throw out this conviction. If the government wants strong convictions with long sentences then they should instead make an immigration violation something greater than a civil violation.

Corey says he didn’t want to “give away” Silver Lake just to “save money” ?

HUH? What kind of fiscal republican does not want to “save money” ?

The Bull Run Mountains Conservancy has dropped out of negotiations with the Prince William County Park Authority over the property at Silver Lake.

A conservancy statement released Tuesday stated that the organization pulled out of negotiations because a stalemate on the Prince William Board of County Supervisors negated further negotiations.

“At this point our continued involvement can only delay opening the property to the public,” the release stated.

The property was proffered to the county by Toll Brothers in 2006 in exchange for 420 additional houses in Dominion Valley.

The conservancy was offering to combine an additional 268 acres with the county’s 233 acres at Silver Lake off Antioch Road near Haymarket if the county deeded portions of the property to the conservancy.

Additionally, a private grant would have allowed the conservancy to open a park at no cost to the public.

The conservancy was prepared to guarantee public access and certain recreational uses and accept deed restrictions that would return the land to the county if the conservancy ceased to exist or failed to allow public access.

Prince William Chairman Corey A. Stewart, R-at large, didn’t want to give away the property in order to save money.

Opening the property could cost the park authority as much $215,000 annually.

Supervisor W.S. “Wally” Covington III, R-Brentsville, didn’t like the plan because it hadn’t been subjected to the budget process.

Supervisor Maureen S. Caddigan, R-Dumfries, said having the conservancy run the park was a “no-brainer” that carried obvious benefits.

The Prince William Conservation Alliance favored the conservancy’s proposal, said Kim Hosen, the alliance executive director.

“In our view we have a problem here,” Hosen said. “We have a severe shortage of parkland and a severe shortage of money. It appeared that this was a win-win for everybody.”

It’s difficult to protect green space and open parkland in Northern Virginia, Hosen said.

“I think it takes partnerships to pull things off,” she said.

Hosen wasn’t worried by the prospect that the conservancy would have owned portions of the property.

“They were willing to sign a contract with the county and accept deed restrictions that would define the uses and public access,” she said.

Michael Kieffer, the executive director of the conservancy, said the conservancy’s withdrawal allowed the park authority a chance to move ahead on opening the park.

PWC NEW Adult Detention Center Opens

We have a new ADC for Prince William County, Manassas, and Manassas Park. It will begin to house inmates next month. The new ADC is long overdue, and finally complete.

One of the best things about having the new facility is that inmates who are currently “farmed out” out to other jurisdictions will be returning to the area. This will be a big savings to us the tax payers. We’ve been spending a fair amount of money on our inmates to be housed in other facilities. We aren’t able to farm out any person with an ICE detainer.

The new facility was also featured during yesterday’s Board of Supervisors meeting. It showed the project from start to finish. The presentation will re-air on Channel 23 or Channel 37 the next three nights at 7:30, and then on Saturday and Sunday at 10am.

One of the neatest features is the “video visitation.” PWC is the second jurisdiction in the Commonwealth to use this technology, Virginia Beach was the first. One of the big benefits of this new technology is there’s less possibility of contraband getting in the hands of the inmates.

Racist and Redneck: Divisive Words Surface…

And have the potential of biting a 17-term congressman in the butt.

The Pennsylvania Rep. John Murtha saga continues. He can’t seem to quit putting his foot in his mouth. The Democratic congressman first got in hot water last week by explaining “There is no question that western Pennsylvania is a racist area.”

Quite understandably, his constituents from Western PA didn’t think much of this description. Rep. Murtha tried to clarify his statement by explaining that the older folks weren’t really racist, just redneck.

That should have reassured those constituents in question. {{sarcasm button on}} Still, Murtha predicts an Obama win in Pennsylvania.

According to ABC news,

The 17-term Democratic congressman told the Pittsburgh Post-Gazette in a story posted Wednesday on its Web site: “There is no question that western Pennsylvania is a racist area.”
Murtha said it has taken time for many Pennsylvania voters to come around to embracing a black presidential candidate, but that Obama should still win the state, though not in a runaway.

One Nation, according to Johnny Cash

As we duke it out these last 2 weeks, trying to get our candidate to the White House, it can be difficult to see ourselves as having a darn thing in common with those who don’t support our guy. Stolen signs and divisive words seem to rule the day. Democratic red, white, and blue is somehow different from Republican red, white, and blue.

Johnny Cash somehow reminds us that most of our goals are the same, regardless of party or other things that divide us. Perhaps Cash is the real Uniter.

Barack Obama, the Democratic Party’s candidate for President, plans a late afternoon rally at Leesburg’s Ida Lee Park on Wednesday, Oct. 22. Gates open at 3 p.m., with the rally scheduled to begin at 5:30.

Although the event is free, Obama campaign officials urge individuals attending the rally make reservations at www.VA.barackobama.com. For security reasons, no banners or signs will be allowed. Also, bags will not be permitted and personal items should be limited.

The visit to Loudoun County will be Obama’s first of his two-year-old campaign for the nation’s highest elected office. He appeared at Robinson High School in Fairfax County for a rally prior to the convention, while his running mate, Sen. Joe Biden, recently held a rally in Sterling

PWCA: Silver Lake – Opportunity Lost

This is a real disappointment. Back in April we hoped that the Prince William Park Authority and Bull Run Mountain Conservancy could reach an amicable agreement with respect to the Silver Lake parcel, apparently those discussions have failed.

The following is an email from the Prince William Conservation Alliance:

Silver Lake: Opportunities Lost

October 21 2008 — The Bull Run Mountain Conservancy (BRMC) today announced the withdrawal of their proposal to partner with Prince William County to open Silver Lake as a park for public use.

That means:

* County taxpayers will now pay all costs to develop and maintain the 233-acre Silver Lake – $1.6 million + $215,000 each year, according to the Prince William County Park Authority (PWCPA) plans;

* An additional 270 acres next to Silver Lake will NOT be opened to horse trails, hiking, and other public uses (BRMC had a commitment from an adjacent landowner to make an additional 270 acres available for public recreational use).

The Silver Lake property was donated (as a “proffer” for County approval of 420 additional houses in Dominion Valley) to Prince William citizens, through the Board of Supervisors, to provide much needed land for public recreation and open space.

The County has kept Silver Lake closed while debating who should manage it. The core issue was land ownership, with some insisting that PWCPA ownership of the entire site was non-negotiable.

The BRMC proposal required transfer – with deed restrictions that pre-determined recreational uses, guaranteed public access and prohibited any resale or transfer – of the land they would manage in order to raise the matching funds required by their $500,000 grant for Silver Lake.

Non-profit organizations like BRMC are unable to attract donations for building a visitor center or other improvements on property that is owned by a government agency. Transferring County land to non-profits is not a new concept. For example, Prince William County donated 135 acres for the Marine Corps Heritage Center.

In the most recent negotiations, the PWCPA would have received the southern portion of the property, including Silver Lake itself. The northern portion would have been transferred to BRMC, with restrictions that guaranteed public access for recreational use. The northern portion would have reverted back to the Board of Supervisors, should BRMC not honor their commitments.

However, after two years of discussion, Prince William Supervisors appear hopelessly deadlocked and, on September 17, the PWCPA Board adopted a resolution by a 6-2 vote rejecting all compromise proposals at Silver Lake.

By rejecting such a compromise, the County will lose the opportunity to develop a 500-acre park with equestrian and hiking trails. Instead, County taxpayers will have to pay 100% of the cost to open up a 233-acre Silver Lake park.

The PWCPA has been struggling to maintain existing recreation amenities, even before the coming budget cuts. In a worst case scenario, Silver Lake could be locked up tight like Dove’s Landing, with signs saying ” Public Land – Keep Out.”

The 270 acres and $1 million in private funding to develop and operate Silver Lake for public use is now lost. The property that could have been added to Silver Lake won’t be developed into townhouses; it is permanently preserved in an open space easement. However, that private land will stay private, closed to the public.

With only 9 acres of parkland/1,000 residents, Prince William is facing an uphill battle to acquire enough new parkland to meet community needs. By rejecting the BRMC partnership, county officials will not acquire new parkland to meet the standards set in the newly revised Parks & Open Space Chapter of the Comprehensive Plan.

In fact, since that plan was adopted, the county has acquired no property for public parkland…. and now has rejected 270 acres of free land.

The Prince William County Park Authority has promised to open Silver Lake to the public in less than a year, with some areas open within six months – so long as the Board of Supervisors provides additional funding.

Will the County find the additional funding needed to open and operate a park at Silver Lake? Or will we see yet another “Public Land – Keep Out” sign?

PWC McCain Supporters Squelch Hate Propaganda

“At a John McCain rally in Woodbridge, Virginia, three people handed out “Obama for Change” bumper stickers with the Communist sickle and hammer and the Islamic crescent, saying Obama was a socialist with ties to radical Islam. Several moderate McCain supporters, Muslim and Christian alike, struck back – relentlessly bombarding the group distributing the flyers until they left the premises.”

American News Media Called on to do a Penetrating Exposé of Congress for UnAmerican Views

I thought McCarthyism was a relic from the past. I thought McCarthyism was a post-WWII overreaction by some zealots to the perils of communism. I thought McCarthyism was dinosaur thinking whose imprint was left back in the late 40’s and the decade of the 50’s. Looks like I was way off base. It is alive and well as evidenced by an interview with Minnesota Congresswoman Michelle Bachmann.

Congresswoman Bachmann is calling for the American news media to do ‘a penetrating exposé of Congress for un-American views.’ Would this be the same Mainstream Media all the darlings of the far right howl about on daily basis?

MSNBC pit-bull Chris ‘Hardball’ Matthews tries to hone in on exactly what Ms. Bachmann really means when she uses the terms ‘liberal’, ‘leftist’, and ‘anti-American’. Congresswoman (shudder) Bachmann is wound up tight and has her talking-points microchip all energized as she withstands a good grilling by Matthews. She doesn’t miss a beat while she castigates Presidential Candidate Obama as one who ‘pals around with terrorists.’

You have to see it to believe it.

Corey Stewart Brings McCain to Prince William

In today’s Washington post, columnist Marc Fisher quotes Corey Stewart as taking credit for yesterday’s McCain campaign rally where approximately 10,000 Virginians gathered to cheer on their candidate.

According to Stewart the entire election hinges on Prince William and Loudoun Counties:

“I literally begged the campaign to have McCain or Palin visit…Prince William and Loudoun are the swing counties where this election will be won or lost. This is the battleground, and Obama and Biden have been here four times.”

Fisher further elaborates in his article,

Stewart, who won statewide notice by pushing for his county’s tough enforcement drive against illegal immigrants, says McCain has done himself and the party a disservice by steering clear of that issue. “But the reality is that McCain has never been strong on this issue,” Stewart says, “and his differences with Obama on it are not very big.” McCain has alienated some conservatives by proposing to let illegal immigrants stay here as guest workers and earn U.S. citizenship.
Although the emotional power of the issue has dissipated in Prince William — Stewart says that’s because the get-tough policy is working and many immigrants have left the county — he’s confident that a presidential candidate who emphasized a crackdown would be rewarded with victory in Virginia.

Was this the same Corey Stewart who was out cheering up Senator McCain at County Complex yesterday? I wonder if that was before or after he threw the candidate under the bus in his interview with Marc Fisher.

Did someone forget to reset Stewart’s robo-chip? Does he ever think of anything other than illegal immigration? No one can accuse Corey Stewart of getting off task, regardless of how much the data changes.

Fisher explains how Ken Cuccinelli and Jeff Frederick see things differently in an election year in his column.

It’s so reassuring to be led by an individual with so much personal stature and so much influence on a national campaign here in little old Prince William County.

Will the ‘Real Virginia’ Please Stand Up?

Talk about gaffes. McCain’s adviser Nancy Pfotenhauer told viewers that McCain had a good chance of taking Virginia because of his support in ‘Real Virginia,’ rather than Northern Virginia. MSNBC host Kevin Cork gave her every chance to get off the ledge. The lady blew her chance.

Ugly in America

 

Don’t say it doesn’t exist. See it with your own 2 eyes. What amazes me is that some people feel this is an ok way to talk in public. We all know of people who say things like this in private, but public? Is that what makes this so different?

Most people don’t feel many of these behaviors are appropriate. Was John Murtha right or was he out of line? He said that Western Pennsylvania was a racist area. Then he backed off a bit, and said that some of the older people were.

Should we expect Prince William to have this kind of performance tomorrow? Absolutely not. Prince William County, despite our rather tumultuous past year, is better than this!

America has a ways to go, it seems. A long way to go. Seeing something like this sort of leaves a person speechless.
