Letiecq’s thread entitled the ‘Traitors In Our Midst’ is as close as actionable litigation as I have seen posted on any blog site. Honestly, you’d think that someone who thought their Puerto Rican neighbors were ‘illegals’ might be a little more cautious in his future allegations. Personally, I’d love to see some Chipotle attorneys decend upon him with a ‘cease and desist’ order. Or better yet, SUE SUE SUE….
In case you haven’t had the opportunity to read the lunacy first hand, here it is –
I am writing this to inform about the General Manager from Chipotle in Manassas. Her name is Juana and she is from El Salvador. She works in the Liberia location in Manassas. I used to work in Chipotle and at that time Juana told me about her ties to the MS 13 gang. I reported this to Chipotle but no action was taken. She is also illegal. She does not have documents to work in the US. Chipotle knows this. Now she is the General Manager. And she is in charge of hiring other employees. She has pretty much filled her restaurants with illegals. Someone should stop this.
Then Letiecq continues on with his basis allegations from an unnamed source which most likely is either a disgruntled employee or conceivably Letiecq himself who seems anxious to attack anyone or anything associated with Mexicans even if it’s an American company with the word ‘Mexican’ in the title, like Chipotle Mexican Grill.
My only question is how long will it take before Letiecq accuses the company of being part of a zapitista reform movement? This wouldn’t be too much more far fetched than his current attempts to tie a Mexican restaurant to an El Salvadorean gang.
So according to this person, when you patronize Chipotle, a portion of the money you pay them is used to provide financial support to the Mara Salvatruca 13 gang. How lovely. I wonder how many patrons are aware of this, and whether they might change their spending habits if they knew.
He tries to suggest the unnamed person intimates ties between the corporation and an MS13 gang when in fact it is he himself who makes the assertion.
One can only hope a Chiptole attorney gets wind of this lunacy. Any bets on whether or not this thread will be permitted to stay on his blog?
Good research, Alanna. Sounds like there’a good legal case against Greg Letiecq based on the Virginia Statute. He should be sued. Greg Letiecq is a liar and a coward.
Based on Alanna’s research, we might take a stab at guessing who is a public figure, who is a limited-purpose public figure and who is not.
Let’s get this out of the way: GL and Duecaster are public figures. HSM members, if they speak out, are either public figures or limited-purpose public figures.
When it comes to the immigration issues, I’m a limited-purpose public figure, I suppose. However, I maintain I am limited to the immigration issue, which means you can’t drag other issues into your discussion about me personally. The same goes for Alanna and Elena and Eric and Annabel etc.
Juana is quite obviously a PRIVATE figure! She needs the most protection, and I hope she gets it.

Hello, it’s not just about being a public figure. It’s about the effects of the action.
Defamation: “These statements are so egregious that they will always be considered defamatory and are assumed to harm the plaintiff’s reputation, without further need to prove that harm. In Virginia, a statement that does any of the following things amounts to defamation per se:
* attributes to the plaintiff the commission of some criminal offense involving moral turpitude, for which the party, if the charge is true, may be indicted and punished;
* indicates that the plaintiff is infected with a contagious disease;
attributes to the plaintiff unfitness to perform the duties of an office or employment of profit, or lack of integrity in the discharge of the duties of such an office or employment; or
* hurts the plaintiff in his or her profession or trade.”
I hardly think my perceptions of people’s behaviors affect any limited-purpose public figure’s ability to earn an income. I just do not hold that kind of influence or status or authority. At most, I might have infuriated and/or hurt someone’s feelings. In the case of hurting feelings, it wasn’t my intent to do so, but I will not go down that worn road again.
Conversely, my being called a “fat broad,” a “socialist”, a “radical”, an “unstable person”–and being referred to as using a vibrator, while being called “douche bag,” “bitch” and other things, while being mocked for having ADHD–doesn’t hurt my ability to earn a living.
Furthermore, calling an anonymous poster any kind of name invalidates the claim of defamation since the poster’s identity is unknown. If being offended were the criteria for a defamation claim, everyone in the blogosphere and in the world would be in court.
It is very difficult to prove defamation except in the case of Juana who has been accused of a crime and who is not a public figure.

Here’s my 2 cents on this (which are worth even less than 2 cents). From a purely pragmatic point of view – I agree with what someone way above said: the better approach would be to insist Chipotle use e-verify and petition the chain to do that. As far as MS-13 or any other gang – if employees are gang members hopefully sooner or later they’ll do something stupid (without inflicting damage on some innocent bystander) and get arrested. Then, they’ll be in jail and go through legal system, and of course be subjected to 287g – and if found to be illegal maybe will be deported if crime is severe enough.
That’s my take on all this – forget all these accusations and stuff. Insist Chipotle use e-verify – that will take care of illegal versus legal immigrants. The gang member situtation will hopefully take care of itself through legal means. Unfortunately, one would like to be proactive in preventing gang members making inroads into this area and causing violence, in practice that is hard to do. Before anyone jumps all over me – I’m not saying one way or the other that any Chipotle employee is a gang member, or that they are illegal. I know I had to put that in from prior experience right here on antibvbl, for fear of getting all sorts of ugly labels applied to me.
Anyway, for what it’s worth – that’s my take on this whole thing. MAking potentially false accusations about people is stupid and indeed makes one liable for lawsuits. That being said, plenty of false accusations have been made here on antibvbl in the past – and while indeed you can hide behind the “one is anonymous and not a public figure on this blog” it still in my mind is nearly as bad as what some people here are taking great offense to in this particular case. Again, I agree, it is not smart to do this in this particular case, and can well indeed lead to a lawsuit. Will be interesting to see what happens. Personally, I’d like to see all businesses use e-verify, or else get heavily fined. That would be the best way to solve the problem of illegal aliens obtaining employment illegally (if that sentence makes any sense – I could not think of any better way to put it).
That’s what I have to say on this topic.
As far as defamation of character, interesting, but I was just recently (a month or two ago) once again falsely accused of doing something I did not do regarding this blog. Again, I’m putting it in the past but I find it a little bit hypocritical to be posting stuff about defaming one’s character when it has been done quite often here on this blog, by a subset of posters and a subset of the administrators.
Regarding French Candians – I have a sister that lives in Burlington, VT. The French Candians are not well liked up there – probably because of some subset of them behaving badly. It is an interesting point Juturna raised however. Although, I don’t know if any sizeable percentage of them are illegal aliens – probably not as people can still move pretty freely back and forth between Canada and USA to conduct business, etc. You do need passport now, until recently you didn’t. Last time I was up there just crossed border with birth certificate and driver’s license – maybe 3 or 4 years ago.
And yes, from a legal point of view – making false comments about a blog poster who is anonymous is not defamation of character. From a moral point of view? Definitely poor form, and no excuse for it. However, they are legally in the clear, but that does not make it “right”.

Who are you? Does anybody know. You were once Leaving Point of Woods, so is the case going to be GainesvilleResident v. Alanna Almeda or LPOW v. Alanna Almeda? You are an anonymous individual, what was said that defamed your character? I made an honest mistake, and then apologized. I believe I released all the comments that were held in moderation. If there’s any that you think defamed you, bring them to my attention and I’ll review it.
Give me a break – while I was in moderation you put words in my mouth, then other people jumped on the bandwagon, etc. It’s all there in the records. You can read what I said, which was hidden at the time, what you wrote I said, which was not what I said, etc. I just think it is hypocritical for you to talk about defaming one’s character when my cyber identity was attacked on here fairly mercilelessly. Again, it was 100% legal what was done on here – but was it moral or eithical? No. And if you were wrong about me and what I allegedly did or didn’t do on antibvbl, then maybe there’s other things you are wrong about or misinformed about too. And it isn’t just about you, but other individuals here who think they are always right – and made a bunch of 100% false assumptions about me – who like to get on their high horse now and get all indignant about defamation and slander. I just find it interesting. I’m not saying I’m 100% right on any one subject, but I just find this subject interesting along with comments by certain subset of posters on antibvbl.
I hate rehasing this, but subset of people here get all offended by what they perceive is bashing, but they think it is fine and even defend their actions.
I just wanted to point out the hypocrisy and unmoral behavior. If you disagree with me, and if others disagree with me, that’s you and their right, of course. But I was silenced on here for quite a long time, for something I did not do, then for a short time silenced again and during that time my words were not seen and yours was – and you put words in my mouth, etc. Take a good look at that thread and read what I wrote and what you wrote while my comments were hidden.
I’d rather not rehash this, and I 100% agree Greg is in the wrong here. But other people while not from a legal point of view are in the wrong, from a moral/ethical people are very very wrong. THAT is the point I was making.
The facts are with me – and I also have several theories as to what really happened that caused me to get in moderation. I’m not going to go into them here – and for one thing it would put up info I have been made privy to that probably isn’t public knowledge here on antibvbl, and I did NOT know until after the latest time I was put in moderattion. Enough said!
I’ll let it go, but I just could not keep silent in this thread. It is not my nature when I feel like I have been unfairly accused of a bunch of horrible stuff I allegedly did in the past.

If the offense were so egregious, most people would just avoid the blog thereafter.
Gainesville Resident is getting some kind of satisfaction from returning to a blog that has so obviously offended him or her. Repeated attempts to apologize only serve to feed into his or her unhealthy source of gratification.
I had a nice response typed up the other day but I lost my internet connection when I hit submit. Basically, I laid out the case why it appeared you could be a ‘trouble maker’.

I hope you are wrongly dragged through the mud, accused of making posts you are not (which I never saw that accusation retracted on here) and I learned I was accused of doing some other things that I would not personally do. you do not know me, HOW DARE YOU MAKE JUDGEMENTS! And I know something else I was accused of that was never mentioned on here -which was REAL reason I was recently banned (even though ban lasted only 24 hours or so roughly).
