Dick Black’s statement regarding Senate Bill 722:

There is a Federal Statute that says that if you give in-state tuition to unlawful immigrants then you must give in-state tuition to Americans from other states.  It just makes sense that Americans should receive as much consideration as people here illegally.  Giving in-state tuition moves illegal immigrants to the front of the line.  For every unlawful person who get in-state tuition, there will be an American who can’t go to college in Virginia and that’s unfair.  Any time you give something free to a person here illegally, you have to take it from an American.

I would like to see a copy of that law.  I find it hard to believe that there is a law stating such bullsh!t.

Giving in-state tuition is not a finite situation in that there are is no set number of allocated in-state tuition slots.  There is no line.  No one is taking anything from an American.   It isn’t “giving something for free” either.

The immigrant kids who would be eligible for in-state tuition would have served their residency requirement just like every other Virginia kid.  They are Virginia kids.   They have lived here, worked here, studied here, and paid taxes.

The Virginia law is clear.  Let’s not obfuscate the laws because Virginia laws don’t fit into Dick Black’s world vision which mandates that he hand out plastic fetuses.  I hope this year he hands out little tiny bricks to place on their heads, just in case their mothers are illegal immigrants.

Dick Black’s amendment is pure BS because those kids have received a status designating them as Temporary Protected Status.  Since 2007, all Virginia college students with the permit, called TPS, are eligible for the tuition break, officials said.  According to the Washington Post, this decision was made under Governor Robert McDonnell.

Those protected by DACA laws should also be eligible.  Let’s let those residents  who have gone to school here in the Old Dominion  and have grown up as Virginians alone.  To quote that immortal bard, Sting, this is “the last humiliating kick in the crotch.”

    I can’t decide what’s more disturbing: 1) Dick Black says this kind of thing thinking it is true; or 2) Dick Black knows it isn’t true, but figures that his constituents are such manipulable dolts that they can be aroused to hysterical pro-Black fervor by his saying stuff like this.

    I guess in the current state of American politics, I have more respect for politicians in category no. 2). At least there is the possibility that when the chips are down, they could think their way to a position that is in the best interests of the country/state/municipality. Pols in first category can’t think their way out of their positions.

    We have an investment in these kids. We have educated them, in most cases k-12, and I want them going on, learning more, getting a good job and contributing to our state.

    Texas, California, New York, Utah, Illinois, Washington, Oklahoma, Kansas, New Mexico, and Nebraska are among the states that provide in-state tuition. They each have their own residency requirements that get around the provision – just like Virginia does in that the parents have had to have paid income tax for the residency year.

    No state has had any problem establishing residency requirements that preserve in-state tuition for in-state residents. Black either knows this or is ignorant of it. As I said in my earlier comment, I’m not sure which is worse.

    Now, I think the original charge here was that Sen. Dick Black was either (1) ignorant enough to refer to a law that doesn’t exist; or (2) deliberately lying about the existence of such a law.       Plastic fetuses just piss me off because Dick Black thinks that solves the issue and that he has really “gotten” everyone with his cleverness. Then he votes against Planned Parenthood. I just think he is stupid and a horrible legislator.

      This latest stunt to try to make it financially difficult, if not impossible, for young people whose parents were undocumented immigrants, to go to college in Virginia. He really is a very basic person and doesn’t look beyond his nose for solutions.

      I have no idea how he got elected. What do you folks put in the water over there. I understand how Bob Marshall gets elected. Black., not so much.

    In-state college is a zero-sum gain. The choice is between being “mean-spirited” toward illegal aliens or being “mean-spirited” toward American citizens.

    So long as state-supported universities in Virginia are not allowed to give preference to illegal aliens as minority students, then there might be room for compromise. Head-to-head competition between illegal aliens and legal residents in which applicants with the best scores and highest academic rankings are admitted is one thing, but “affirmative action” for illegal aliens is quite another.

    You might reasonably point out that no one has mentioned affirmative action for illegal aliens. However, once illegal aliens are eligible for in-state admission, there is nothing that I know of that would prevent them from being considered as minority applicants. This would then give them preference over more highly qualified American students. That would be extremely unfair to American kids who worked hard, did the right things, but are denied acceptance in favor of less accomplished students who are not in the country legally.

    1. I don’t know who is doing affirmative action and who isn’t. However, what is the difference in a highly qualified student in status and a highly qualified student whose is not in status because of DACA?

      I will have to go on record as not being a fan of affirmative action. I have seen it misused far too much over the years. At any rate, I have heard no mention of it having anything to do with in state tuition. Right now, I believe the DACA eligible students may apply to any college. If they have the grades, they will be considered.

    I normally stay far away from the abortion issue, since positions are so hardened on both sides and there’s just not much room for compromise. I’ll just say that Black’s creepy baby stunt was to get publicity and it worked, although not completely in the way he might have intended. I know a lot of folks (on both sides) who totally discounted him after that.

    Speaking of creepy baby figures, has anyone ever had a King Cake from New Orleans around Mardi Gras time? My Dad used to send us one every year, and I would do my best to NOT find the baby inside, even though it was supposed to bring luck. Just too weird!

Joe Morrissey is a once and future disbarred attorney and convicted statutory rapist. Dick Black may be interpreting the law from a conservative perspective.     So, if we are going for some kind of moral equivalency, I think you might want to pick a different Dem to use as a yardstick. When you look at these men, which one do you think holds a woman/children in higher regard? The man who flew choppers into hot LZ’s to extract wounded husbands, fathers and sons, at great risk to his own life? Or the “gentleman” from Henrico, who screws a 17 yearold girl on the conference room table in his law office?

    And if you want to claim Dick Black (also an attorney) is “lying”, when there is and actual US code section cited, then you need to consider Joe Morrissey’s claims made on the House floor:

    “A lot of people don’t know that in many locations in the commonwealth, you can take this gun, you can walk in the middle of Main Street loaded and not be in violation of the law.”

    The reason a lot of people don’t know this, is because Joe was flat-out lying. It is illegal to carry a long-gun, let alone a loaded long gun, in public, or on a public road, unless you are engaged in lawful hunting, and have the permission to hunt on the private land on BOTH sides of the road.

    I thought Black’s stunt silly. I thought Morrissey’s stunt dangerous.

    I didn’t mention Joe till you did, comparing Black to Morrissey, and made plastic fetuses germane to a discussion on illegal immigration. Joe Morrissey has issues with “skirts” and “truth”.

    Again, and I repeat, it was you who made the linkage and references to Joe Morrissey, plastic fetuses and impugning the integrity of Dick Black. What does this have to do with Black’s proposed legislation? Dick Black is an attorney. He practiced Military Law as both a JAG officer, and civilian attorney. I would surmise that he is qualified to 1) research precedent and case law, and 2) reasonably interpret the application of the federal law. With items #1 and #2 as supporting my argument, I refute your assertion that Dick Black doesn’t know what he’s talking about, (I believe you called him a liar), regarding the legal basis for his proposed legislation. I would further assert that your perception on this issue is significantly colored by your own views on pro-choice issues (note, I did not use the “A” word”). You referred to Dick Black as a “fool”, and proceeded to make some subjective measure using Joe Morrissey as the “Fools Yardstick” and came up with an equivocation. I am refuting that.

    If federal law does in fact prohibit what the McAuliffe admin is trying to do, ie. executive action, then Dick Black is performing his sworn duty to “protect and defend the Constitution of Virginia”, against an illegal action. You may not like him, but he’s not fool, and certainly shouldn’t be compared to Joe Morrissey.

      I do think Dick Black is a fool. I also think he is a liar based on remarks he has made about the A word. I think he is a liar about in-state tuition. What’s worse, I think he knows better and is simply acting to stir up his base at the expense of kids who have overcome a lot of odds and jumped over many hurdles to get where they are today. That is unforgivable.

      To me, pro-life doesn’t end at birth. Obviously Black wants to drive a point home at these kids’ expense.

      I am glad the bill failed. Apparently at least one man had a conscience when it came to immigrant kids.

      These kids could have just as easily been drop outs, joined a gang or sold drugs. Instead, they worked hard and had academic accomplishments.

      Dick Black should not let facts get in his way. Plenty of attorneys know truth from fiction and twist and garble the the truth to get the end result they want or need.

      This is the bill this year that I really cared about. I am happy.
      81 undocumented Virginia kids are taking advantage of in state tuition.

    I guess that depends on how you define “Moderate”. It’s a very subjective term. Same could be said of “Conservative”, considering all the cries of “RINO” (a label I despise).

    On another note, the GOP-controlled VA Senate voted to restore regular rules of order. Remember, these rules were suspended by the Dems, when they controlled the VA Senate, and understand that it was for the sole purpose of dominating the legislative operation of the Senate. So how about some love for the GOP Senate that wishes to respect the role of the “Loyal Opposition” in our democratic process.

    1. I think *I* am a moderate. I also hate the term RINO. I am not sure what conservatives are now. Maybe I just really don’t like labels but feel compelled to use them so I can communicate.

      Not showing any love for the GA yet. So far I have been happy with the one little thing that happened. That’s just a very special topic for me …allowing kids to go to school on in-state tuition. It’s not doled out in specific amounts, that’s why I feel to deny them is so mean spirited. If there were only X dollars to go around, I might…MIGHT…see another point of view.
